- “The Website”, “our Website” – meaning pages, files and other forms of content accessible through the domain jamesfox.ie and any of its subdomains.
- “Order” – meaning a finalised and fully paid purchase of a product or service made using the Website or over the phone, associated with an individual reference number.
These Terms & Conditions are subject to change and may be updated from time to time. When placing an Order, you are required to indicate your acceptance of the Terms & Conditions, as at the time of ordering.
This website is operated by the Company, as defined above. Any content displayed on the Website either belongs to the Company, or has been licensed from a third party to be used by the Company.
We reserve the right to restrict or suspend access to our Website, or any of its features – both for particular individuals and groups, and universally – at any time, without prior notice.
From time to time, content published on the Website may contain external links leading to third-party pages. You acknowledge that our Company has no control over the content of these pages and is not responsible for the quality, nature, and reliability of any such third-party content. Inclusion of such links does not imply endorsement by our Company.
You may not use our Website for any unlawful purposes. This includes, but is not limited to, placing fraudulent Orders, infringing on rights of any other individual or organisation, knowingly transmitting any sort of malicious code (e.g. viruses, spyware, etc.) or otherwise adversely affecting the operation of any software and hardware associated with the Website.
Due to the nature of the technology employed in operating the Website, making it subject to interruption or breakdown, access to the Website should be considered on an “as is” and “as available” basis only.
Unless you have entered into a separate agreement with the Company, you are allowed to use the content available on the Website for personal and non-commercial purposes only, such as:
* display the content on your screen in the course of regular Website usage,
* store any part of the Website content as electronic copies or physical printouts for personal use.
Usage of our Website implies your confirmation that you are over 18 years of age. Notwithstanding any laws applicable in your own jurisdiction, persons under 18 years of age are not allowed to purchase or receive any goods or services through our Website. We reserve the right to request additional verification of customer's age where the Order contains any items restricted to over-18s, and the customer account hasn't been verified this way previously. Such verification, when requested, will be a mandatory requirement to fulfil the Order.
We take reasonable care to ensure information provided on our Website is up to date, accurate, and free of errors. Any such errors will be corrected as soon as practicable upon detection. To account for any unintentional errors or omissions, we are unable to guarantee full accuracy of any information provided (e.g. product information/pictures, stock availability and pricing).
Any content published on the Website (including pricing) may change at any time, without prior notice.
In cases where certain particulars of a product must match your exact requirements (e.g. a particular batch number, ABV, bottle design, production date, etc.), you are always welcome to contact us in advance to make sure current stock matches these details. Generally, any product imagery presented on the website should be considered for illustrative purposes only.
Where any such errors have an impact on your purchase (e.g. you receive a product that vastly differs from the description presented on the Website), you are welcome to contact us and discuss possible solutions. If we uncover any such error ourselves, we may also initiate contact with you on the basis of legitimate interest.
In cases where any part of your Order cannot be fulfilled, or would result in a significant delay, due to issues with stock availability, we will contact you by email or over the phone as soon as practicable to discuss possible options – these will normally include refunding the relevant part of the Order, or picking suitable substitutes.
(3.1) Pricing & VAT
By default, all prices displayed on our Website are inclusive of Irish VAT, meaning that they’re full prices applicable when you place an Order as a private person with delivery to an address in the Republic of Ireland, or opt to collect it from our store. Product prices exclude any applicable delivery charges, which will be calculated based on the items in your cart and the delivery address, and presented at checkout before you pay.
International customers may avail of certain website features which will make the prices display exclusive of VAT and/or at different VAT rates as applicable for their location. Such features are provided for informational purposes only, and the final calculation of any applicable taxes is done at checkout, after the order contents and destination are provided by the customer, before the payment is made.
Making a purchase through our Website requires full payment before it is finalised and enters the processing stage. We accept the following methods of payment: Visa debit/credit cards, MasterCard debit/credit cards, and eligible gift cards previously purchased and activated on the Website.
Debit/credit card payments are processed by an external payment gateway. During your payment, you may be required to complete additional verification (often called 3DSecure, Strong Customer Authentication (SCA), Verified by Visa or MasterCard SecureCode). These features are operated by the respective card scheme and/or your issuing bank, and we advise you contact these entities in case of any queries concerning this. We as a merchant only receive the final result of this verification, i.e. whether the payment has been authorised or not.
If the Order is placed successfully, the full payable total will be debited from the gift card and/or the credit/debit card you use. You will then be presented with an Order confirmation screen, showing the Order number, its contents and other details for your reference. This information will also be sent to the email address provided at checkout, and we advise to keep it for your records. Email confirmations are usually delivered within a minute or two, but in case of any technical issues, it may take longer.
While we aim to process all Orders as quickly as possible, delays may occur in certain circumstances, such as during particularly busy periods. As a general rule, we aim for all orders received by 12pm (Monday–Friday) to be processed out on the same day.
If you become aware of any errors in your Order details (e.g. wrong delivery address, or incorrect items/quantities ordered), it is imperative that you let us know as soon as possible, ideally by calling us to ensure immediate attention – our ability to rectify any such errors will depend on how far the Order processing has progressed by the time we hear from you.
(4.1) In-Store Collection
Orders placed for in-store collection will be made available to collect as soon as possible (usually within 24 hours, excl. weekends – in practice, we aim to get these ready within an hour or two). A separate email notification will be sent to you once the Order is ready for collection.
If collection of your Order is time-sensitive, we advise to contact us over the phone or by email to let us know, in which case we will expedite it where possible.
The only collection point we offer is our store, located in 119 Grafton Street, Dublin 2. Collections are possible during the store business hours (see this page for our current opening times).
By default, an Order placed for in-store collection is kept for a minimum of 60 days from the day we notify you that it's ready for collection. If you need more time to visit us and collect it, we encourage you to get in touch and let us know – otherwise, Orders that are unclaimed within this period may be cancelled and refunded, while the items in question may no longer be available to re-order.
(4.2) Delivery
We use a number of delivery partners to provide delivery services in Ireland and select international destinations. Please refer to this page for more information on available delivery methods and associated fees.
Delivery time frames presented at checkout are estimates and the actual delivery times may differ, particularly during busy periods (e.g. ahead of Christmas and other holidays). As delivery time frames are not guaranteed, we reserve the right to refuse liability for any delays occurring while the parcel is in transit – however, we are always happy to look into and assist with any such cases to help expedite a solution where possible.
In case of international deliveries, particularly those heading outside of the EU, we advise to check with relevant customs authorities in the destination country to ensure that importing the items you order is allowed, and whether there are any additional charges (e.g. duties or taxes) that may be applicable. Any charges in relation to customs processing and import fees are not included in the product price or our delivery fees, and will normally be due from the recipient on delivery.
Where a delivery is refused on arrival for any reason (including refusal of payment of any outstanding customs charges or import fees), it will normally be sent back to us automatically – such return shipments generally get the lowest priority with delivery companies, so in some cases, it may take a considerable amount of time to reach us. Unless otherwise agreed by the Company, any refunds will only be processed after the return shipment is received. We reserve the right to deduct any costs incurred by the Company in the course of recovering the shipment from any refund due.
In line with EU rules, if you make your purchase online, over the phone or otherwise outside of our physical premises, you have the right to change your mind within 14 calendar days (sometimes referred to as the “cooling-off period”) for any reason. This period starts from the day you receive the items (or collect them from our store if the purchase was made for in-store collection). During this period, you need to at least state your intent to exercise this right by contacting us, at which point you have further 14 days to return the items to us.
Please note that you will need to cover the cost of returning the items (e.g. postage). You are free to use a delivery method of your choosing, although it will be your responsibility to ensure the items arrive on time and undamaged.
Some items are excluded from this right – for example, personalised products made to order.More information about your rights under EU Consumer Law can be found on the official EU website: https://europa.eu/youreurope/citizens/consumers/shopping/guarantees-returns/index_en.htm (link valid at the time of publication).In the interest of customer satisfaction, please feel free to contact us even if the 14-day deadline has passed – at our discretion, we will give consideration to individual cases.
We take reasonable care to ensure any item we sell is in appropriate condition and fully functional, unless clearly stated otherwise in the product description. Where we fail in this regard, and your item turns out to be faulty or otherwise not look or work as advertised, we advise you contact us as soon as practicable and let us know what the issue is – in most cases, pictures will also help us assist more efficiently.
Solutions we offer in such circumstances will vary, depending on the nature of the problem and other factors – often including options such as replacement, repair, credit for future purchases or refund.
Under EU law, you always have the right a minimum two-year guarantee which, in case of some items, may be supplemented by commercial warranty offered by the manufacturer of the product.

The Website uses industry-standard SSL encryption across all its pages and features, particularly when transmitting personal or otherwise sensitive data (e.g. names, addresses, payment card details).
We value our reputation for excellent service and believe there no issue that cannot be resolved to a reasonable extent. To ensure your complaint is addressed as efficiently as possible, please be ready to provide as many details as possible – e.g., in case of an issue with an existing Order, the Order number and other information from it will help expedite any potential solution. Please note that, due to our data protection procedures, we can only discuss details of a particular purchase with persons named in the billing or delivery information in the Order.
As our Company is based in the Republic of Ireland, both our operations and these Terms & Conditions are governed by the Irish law. Any claims arising from, or related to, a visit to our Website, or any purchase made through the Website, will remain under non-exclusive jurisdiction of Irish courts.
